Welcome to BECx Go (“Company,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of our website, mobile applications, and building enclosure commissioning (“BECx”) software platform, including all related tools, features, and services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Intended Use and Audience

The Services are intended for use by building industry professionals, including but not limited to commissioning agents, architects, engineers, contractors, consultants, developers, and owners.

The Services are professional tools designed to support building enclosure commissioning workflows and do not replace professional judgment, site observations, testing, inspections, or contractual obligations.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements.

3. Use of the Services

You agree to use the Services solely for lawful business and professional purposes related to building enclosure commissioning and related activities.

• Use the Services in violation of applicable laws, regulations, or industry standards
• Upload false, misleading, or unauthorized information
• Attempt to gain unauthorized access to systems, data, or accounts
• Reverse engineer, copy, sublicense, resell, or commercially exploit the Services without permission
• Interfere with or disrupt the security, integrity, or performance of the Services

4. No Professional or Legal Advice

The Services may assist with documentation, workflows, reporting, data collection, issue tracking, and coordination. They do not constitute professional, legal, engineering, architectural, or construction advice.

• All project decisions remain your responsibility
• The Services do not guarantee compliance with codes, standards, contracts, or regulations
• All outputs must be reviewed and verified by qualified professionals

5. Accounts and Security

Some features require account registration. You are responsible for maintaining the confidentiality of your login credentials and all activity occurring under your account.

6. User Content and Project Data

You may upload or generate project data, photos, reports, drawings, notes, checklists, test results, and other content (“Project Data”).

You retain ownership of your Project Data, subject to any applicable project agreements or contractual obligations.

7. Data Retention & Ownership

Data Ownership

All Project Data remains the property of the user or the user’s organization. BECx Go does not claim ownership of Project Data.

Data Use

You grant BECx Go a limited, non-exclusive license to host, store, process, transmit, and display Project Data solely to provide, maintain, secure, support, and improve the Services.

Data Retention

Project Data is retained for the duration of an active account or subscription. After termination, data may be retained briefly for backup, legal, or operational purposes and may then be permanently deleted.

Data Deletion Requests

You may request deletion of Project Data by contacting support@becxgo.com. Requests may be subject to legal or contractual requirements.

Data Security

We implement reasonable administrative, technical, and organizational safeguards, but no system can be guaranteed 100% secure.

Responsibility for Project Records

The Services do not serve as the official or sole record for any project. You are responsible for maintaining independent copies of all Project Data.

8. Intellectual Property

All software, workflows, templates, interfaces, branding, and platform features (excluding Project Data) are the exclusive property of BECx Go or its licensors.

9. Availability and Modifications

We may modify, suspend, or discontinue the Services at any time and do not guarantee uninterrupted availability.

10. Fees and Subscriptions

Certain features may require payment or subscription. Unless otherwise stated, all fees are non-refundable.

11. Third-Party Services

The Services may integrate with third-party platforms. We are not responsible for third-party content or availability.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BECx Go SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES.

14. Indemnification

You agree to indemnify and hold harmless BECx Go from claims arising from your use of the Services or violation of these Terms.

15. Termination

We may suspend or terminate access to the Services at any time for misuse or violation of these Terms.

16. Governing Law

These Terms are governed by the laws of the United States.
